Making Emails That Don’t Suck · Drippity Email Marketing

Effective date: July 20, 2026

IMPORTANT BEFORE PUBLISHING: Replace every bracketed field in Section 18 with Drippity’s legal business and contact details, and add the live Privacy Policy link.

1. Agreement to These Terms

These Terms of Service (the “Terms”) form a binding agreement between you and Drippity Email Marketing (“Drippity,” “we,” “us,” or “our”). They govern your purchase of, access to, and use of the online course Making Emails That Don’t Suck, including its videos, lessons, templates, downloads, examples, community features, feedback, updates, and related materials (collectively, the “Course”).

By placing an order, selecting the checkbox accepting these Terms, accessing the Course, or using any Course material, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, do not purchase or access the Course.

You must be at least the age of majority where you live and legally capable of entering into this agreement. If you purchase on behalf of a business, you confirm that you have authority to bind that business.

2. Course Description and Educational Purpose

The Course teaches Drippity’s approach to email strategy, creative direction, copy, design, mockup creation, and implementation. Some demonstrations may use Klaviyo, Adobe XD, or other third-party tools. The principles may be transferable, but the Course does not promise compatibility with every platform, software version, business, or workflow.

The Course is provided for general educational and informational purposes. It is not legal, financial, accounting, tax, or other professional advice. You remain responsible for your own business decisions, campaigns, compliance, testing, quality assurance, and results.

3. Pre-Order and Course Availability

The Course is offered on a pre-order basis and is scheduled to become available on September 1, 2026. We may release materials in stages, revise the curriculum, or make reasonable changes to the release schedule when needed to improve the Course or address circumstances outside our reasonable control.

If a material delay occurs, we will provide notice using the email address associated with your purchase and will provide any remedy required by applicable law. Nothing in these Terms limits a cancellation, refund, or other right that cannot lawfully be excluded.

4. Orders, Pricing, and Payment

The price, currency, taxes, payment schedule, and included features shown at checkout form part of your agreement with us. You authorize us and our payment providers to charge the payment method you provide for all amounts shown at checkout. You are responsible for providing accurate and current billing, account, and contact information.

We may correct genuine pricing or description errors. If an error affects an order already placed, we may cancel the order and refund the amount paid, or contact you to obtain your agreement to the corrected terms.

Unless otherwise stated, you are responsible for any internet access, device, software, subscription, or third-party service required to apply the Course material.

5. Refund and Cancellation Policy

All sales are final and the Course is non-refundable once purchased, except where a refund, cancellation, or other remedy is required by applicable law or expressly offered by us in writing. This policy reflects the digital nature of the Course and the value of immediate or scheduled access to proprietary educational materials.

Notwithstanding the sentence above, nothing in these Terms removes any mandatory rights you may have under consumer-protection law, including rights that may apply if required information is not disclosed, a copy of the agreement is not provided, the Course is not supplied as agreed, or an unfair practice occurs.

To request a cancellation or remedy available by law, contact us at [email protected] and include your name, order email address, order number, purchase date, and the reason for your request.

6. Licence and Single-User Access

Subject to these Terms and payment in full, Drippity grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Course for your own learning and, where applicable, to apply what you learn in your own work or business.

Each purchase is licensed to one individual only. You may not share your login, provide Course access to another person, purchase one seat for use by a team, or allow multiple people to use the same account. Businesses requiring access for more than one person must purchase a separate licence for each participant unless Drippity agrees otherwise in writing.

Your access period is the period stated on the sales page or at checkout. If no period is stated, access will continue for as long as Drippity makes the Course available through the applicable platform. “Lifetime access” means the commercial lifetime of the Course, not your lifetime or Drippity’s perpetual operation.

7. Intellectual Property

The Course and all associated intellectual property are owned by or licensed to Drippity and are protected by copyright, trademark, and other laws. This includes videos, audio, lesson text, designs, graphics, frameworks, processes, templates, worksheets, prompts, downloads, examples, recordings, and the Drippity and Course names and branding.

Your purchase gives you a licence to use the Course as described in these Terms. It does not transfer ownership of the Course or any intellectual property to you.

Unless Drippity gives prior written permission, you may not:

You may use your own completed work product created by applying general skills learned in the Course. You may not distribute or resell Drippity’s underlying templates, lessons, or proprietary materials, whether modified or unmodified.

8. Account Security and Acceptable Use

You are responsible for keeping your login details confidential and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access. We may require reasonable information to verify account ownership.

You must not use the Course or its platform to violate any law; infringe another person’s rights; upload malware or harmful code; bypass security or access controls; interfere with the platform; impersonate another person; harass others; submit unlawful, defamatory, discriminatory, obscene, or abusive content; or collect another user’s information without lawful authority.

9. Feedback, Reviews, and Submitted Work

The Course may include opportunities to submit assignments, questions, creative work, or other material for feedback (“Submissions”). You retain ownership of your original Submissions. You grant Drippity a limited, non-exclusive, worldwide, royalty-free licence to access, reproduce, display, annotate, and otherwise use your Submissions only as reasonably necessary to provide the Course, feedback, moderation, technical support, and platform administration.

We will not use your Submissions in public marketing, case studies, social media, or promotional examples without your separate permission. Do not submit confidential client information, personal information you are not authorized to share, trade secrets, or material that infringes another person’s rights.

Any direct feedback from Broderick or Drippity is educational and may be limited by the scope, format, response window, availability, and submission rules described in the Course. Unless expressly stated at checkout, purchase does not include unlimited feedback, private consulting, custom design work, campaign approval, or guaranteed response times.

If you voluntarily provide a testimonial, review, suggestion, or general feedback about the Course, you grant Drippity permission to use it for business and promotional purposes in accordance with any consent or attribution choices presented to you. You may withdraw permission for future uses by contacting us, but withdrawal will not require us to recall materials already lawfully published or distributed.

10. Third-Party Platforms, Tools, and Links

The Course may be hosted or delivered through third-party providers and may reference third-party websites, software, platforms, plugins, or services. Their availability, pricing, functions, terms, and privacy practices are controlled by those third parties and may change without notice. Drippity is not responsible for third-party products or services and does not guarantee that a particular tool will remain available or function as demonstrated.

11. Course Changes and Availability

We may update, replace, reorganize, or remove Course content to maintain quality, accuracy, relevance, security, or legal compliance. We may also suspend access temporarily for maintenance, technical issues, security concerns, or events beyond our reasonable control.

If we permanently discontinue the Course before the end of a specifically promised access period, we will provide a reasonable substitute, download opportunity where legally and technically permitted, prorated refund, or other remedy required by applicable law. We are not responsible for interruptions caused by your equipment, internet connection, third-party account, or breach of these Terms.

12. Results Disclaimer

We do not promise or guarantee any particular creative, marketing, revenue, conversion, engagement, employment, client, or business result. Examples, demonstrations, testimonials, and past results are illustrative only and do not guarantee that you will achieve the same or similar outcomes. Your results depend on factors including your experience, effort, audience, offer, market, tools, implementation, and business conditions.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the Course is provided “as is” and “as available.” Drippity disclaims all representations, warranties, and conditions not expressly stated in these Terms, whether express, implied, statutory, or collateral, including merchantable quality, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free availability.

Some jurisdictions do not allow certain warranty exclusions. In that case, the exclusions above apply only to the maximum extent permitted by law.

14. Limitation of Liability

To the maximum extent permitted by law, Drippity and its owners, officers, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, savings, business opportunities, goodwill, or data, arising from or related to the Course, even if advised that such loss was possible.

To the maximum extent permitted by law, Drippity’s total aggregate liability arising from or related to the Course will not exceed the amount you actually paid to Drippity for the Course during the twelve months immediately preceding the event giving rise to the claim.

These limitations do not apply to liability that cannot legally be excluded or limited, including any mandatory consumer rights.

15. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Drippity and its owners, officers, employees, contractors, and agents from third-party claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of the Course, your infringement of another person’s rights, your Submissions, or your material breach of these Terms. This section does not require you to indemnify Drippity for Drippity’s own negligence or unlawful conduct.

16. Suspension and Termination

We may suspend or terminate your access if we reasonably believe you have materially breached these Terms, shared access, infringed intellectual property, threatened platform security, engaged in fraud or chargeback abuse, or created a legal or safety risk. Where appropriate, we may provide notice and a reasonable opportunity to correct the breach.

Termination does not transfer ownership of Course materials or excuse unpaid amounts. Sections concerning intellectual property, Submissions, disclaimers, liability, indemnity, governing law, and any provisions that by their nature should survive will continue after termination. Any refund following suspension or termination will be determined by these Terms and applicable law.

17. Privacy and Electronic Communications

Our collection, use, and disclosure of personal information are described in our Privacy Policy: https://drippityemailmarketing.thinkific.com/pages/privacy. By creating an account or purchasing the Course, you agree to receive transactional communications necessary to administer your order and Course access. Marketing communications are optional and may be unsubscribed from using the link provided, without affecting necessary service messages.

19. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Subject to any mandatory rights you have under the law where you reside, the courts located in Toronto, Ontario will have exclusive jurisdiction over disputes arising from or related to these Terms or the Course.

Before starting formal proceedings, each party agrees to make a good-faith attempt to resolve the dispute by written notice and reasonable discussion. Nothing in this section prevents either party from seeking urgent injunctive relief or using a small-claims or consumer-protection process where available.

20. Changes to These Terms

We may update these Terms from time to time. The version in effect when you purchase the Course will govern that purchase, except that later changes may apply where required by law, necessary for security, or expressly accepted by you. We will provide reasonable notice of any material change that adversely affects an existing purchaser’s rights. The effective date appears at the top of these Terms.

21. General

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms in connection with a reorganization, sale, or transfer of the Course or our business, subject to applicable law.

These Terms, the checkout details, the applicable sales page, and the Privacy Policy form the entire agreement between you and Drippity concerning the Course and replace prior discussions or representations on that subject. If there is a conflict, the checkout details control for price and purchased inclusions, followed by these Terms, then the sales page.
